TERMS AND CONDITIONS

 

These are the terms and conditions under which we offer tours of Uyuni Expeditions.


By registering and paying your deposit for a Tour, you are entering into this Participant Agreement with us. Read these terms carefully before making a deposit or payment for a Tour. These terms may be supplemented by additional terms and conditions specific to your trip ("Supplemental Terms"). In case of conflict between this agreement and the complementary terms, the complementary Terms will apply.


Uyuni Expeditions Participation Agreement
Uyuni Expeditions, part of Creative Tours Company, acts only as a travel sponsor and is not responsible for the acts or omissions of other parties. The trip described on the Uyuni Expeditions website (the "Website") or in your brochure (the "Tour") is provided by an independent tour operator named on the website or its brochure (the "Operator"). The tour operators of Uyuni Expeditions are collectively called "us". The terms and conditions of this Participant Agreement apply to your Tour and the program for the Tour (the "Itinerary").

 

Prices and inclusions

The prices of the quoted tours are per person, double occupancy, except where indicated. Prices include programming, planning, management and operating charges, and are based on the exchange rates, tariffs and taxes in force at the time of publication. We reserve the right to increase Tour prices to cover increased costs, fees, taxes and VT. Received after the prices are published and to reflect fluctuations in the currency markets. We will not give a breakdown in the price of a Tour or its parts. Modifying the size of the Tour content will not affect the published price.


Exclusions

The prices quoted from the Tour exclude: travel insurance; air fares between points on the Tour; international air fare, including air fare and other transportation to and from the Tour (unless otherwise indicated); costs associated with obtaining passports or entry visas; airport departure taxes (unless otherwise indicated); charges for excess baggage; Tips to the directors, drivers and guides of the Tour. Meals other than those specified in the Itinerary; visits not included in the Itinerary; and personal expenses such as laundry, communication expenses and optional activities (which are subject to availability).

 

Reservations and payments.

The amount of the Tour deposit can be found on the website or in your brochure. The deposit is required to confirm your reservation. Upon receiving the deposit, the Operator will send you the confirmation of your reservation. Your final payment date will appear on the confirmation. If a Tour is already complete, we will accept deposits in standby mode. If there is space available, you will have the option to join the Tour by paying in full or you will lose the space in exchange for a refund of your deposit. The final payment must be made sixty (60) days before departure, unless otherwise indicated on the website or in the brochure. If your reservation is made within sixty (60) days of departure, the total cost of the trip must be paid at the time of the request to ensure confirmation.


Travel insurance.

We strongly recommend that you purchase insurance that covers travel cancellation and health insurance. The operator will provide the insurance requests together with the confirmation of your reservation. Any questions about what travel insurance covers or does not cover should be directed directly to the travel insurance company. If you reject insurance coverage, you will personally assume full responsibility for any financial loss associated with your travel plans, and you could lose your travel investment and / or have to pay more money to correct the situation.

 

Individual travelers

The prices of the tours are based on double occupancy. Single travelers must pay the individual supplement fee.

 

Cancellation on your part.

We must receive your notice of cancellation in writing by email, fax or courier service, and your cancellation date will be the date we receive your notification.


• Once the tour payment is made, a fine of $ 50 will be applied to cover the administrative expenses in case of cancellation of the tour (applicable only when the tour is canceled before 29 days or more of the beginning of the tour).
• 28-15 days before the start of the tours: 15% of the total cost of the tour.
• 14-10 days before the start of the tours: 30% of the total cost of the tour.
• 9 days before the start of the tours: 40% of the total cost of the tour.
• 8-6 days before the start of the tours: 50% of the total cost of the tour.
• 5-2 days before the start of the tours: 80% of the total cost of the tour.
• 1 day before, or the day the tour begins or after that: 100% of the total cost of the tour.


Your decision not to participate in the Tour due to State Department warnings, fear of travel, illness or any other reason will be considered a cancellation. If a flight or other delay for any reason prevents you from joining the Tour on the date and time of departure of the Tour, it will be considered as if you do not show up, and we can not provide a full or partial refund or credit for a future Tour, but You can join the Tour later if you wish.


Air transportation during the tour.

Domestic air transportation is not included in the tour price. The estimated internal air costs will be identified separately on the website or in your brochure. Internal air costs and availability are subject to change at any time prior to the final payment of your Tour and we reserve the right to increase the Tour's prices accordingly. We will not change your seat assignment request on commercial aircraft without your permission. However, airlines often change seat assignments to satisfy their loyal members or due to changes in equipment (aircraft type). We are not notified of these changes in advance and, often, travelers are not informed of these changes until they arrive at the airport. We can not be responsible for changes in seat assignments made by the airline. Frequent flyer programs are private agreements between airlines and passengers, and we can not be held responsible for mileage discrepancies involving airline loyalty reward programs.


Passports and visas.

You are solely responsible for complying with the passport and visa requirements. For foreign travelers, international travel requires a valid passport six (6) months after the expected return travel date. In many cases, you should also have several pages of consecutive blank visas in your passport (the number varies depending on the destination (s)). Many destinations also require that visas be obtained before the trip. It is recommended that you verify with the authorities of your country the latest passport and visa requirements.

 

Cancellation or substitution by our part.

We will make commercially reasonable efforts to maintain the Itinerary as it has been published; however, the final itinerary may vary due to availability and factors beyond our control. We can, at our sole discretion, substitute services such as hotels or goods of similar quality for any service or good established in the Itinerary. If a speaker of Uyuni Expeditions ("Speaker") is canceled, the Operator will do everything possible to find a replacement. You will not be reimbursed in whole or in part when the Operator can not find a replacement Speaker.


We reserve the right to cancel any Tour due to improper enrollment that makes the trip economically unfeasible to operate or due to our concerns regarding the safety, health or welfare of our travelers or staff. If we cancel a Tour, our liability is limited to a full refund of your payments to us and we will not be responsible for any other cost, damage or refund of any kind for any loss, delay, inconvenience, disappointment or expense of any kind in such circumstances. . If a Tour in course should be interrupted or canceled, our liability will be strictly limited to the reimbursement of the recoverable cost of any unused portion of the Tour.


Other taxes and fees.

Some governments charge taxes and / or exit fees. These fares are the responsibility of each passenger traveling to the designated country and are not included in the Tour price unless indicated.

 

Luggage.

We assume no responsibility for the loss or damage of luggage in transit to and from a Tour or while on a Tour. We recommend buying a supplementary travel insurance package.


Children.

Unless otherwise indicated in the Tour description, all Tour passengers must be at least eight (8) years of age. However, some activities included in an Itinerary may have an age restriction different from the general minimum age requirement, in which case the details will be provided at the time of booking. We reserve the right to marginally exceed the maximum group size published in Family Tours to accommodate a family.

 

Suppliers Acts or omissions.

The Operator acts only as an independent contractor to supply or coordinate the travel services named in its itinerary or otherwise to obtain services or goods from third parties, such as airlines, hotels and other accommodation providers, local hosts, guides, bus lines , car rental companies, driving services, restaurants and entertainment providers (the "Suppliers"). The Tourist Operator of Uyuni Expeditions does not assume any responsibility for personal injuries, property damage or other losses, accidents, delays, inconveniences or irregularities that may be caused by any act or omission of any of the Suppliers.

 

Conduct during the Tour.

You are responsible for respecting the authority and following the instructions of the Tour guide and the laws of the countries in your Itinerary during a Tour. We may exclude you from participating in all or part of the Tour if, at our sole discretion, your condition or behavior makes you unfit for the Tour or not fit to continue once the Tour has begun. It may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of Tour services or may constitute a danger or embarrassment. In such case, our liability will be strictly limited to the reimbursement of the recoverable cost of any unused portion of the Tour.

 

If for any reason you decide not to participate in certain parts of the Tour or use certain goods included in the Tour, no refunds will be made for those unused parts of the Tour or goods. You agree to indemnify us and exempt us from any cost, damage, loss or liability arising out of (a) the actions or omissions of minors traveling with you and (b) if you checked the box indicating that you are signing On behalf of yourself and of his fellow travelers, the claims of his companions that he was not authorized to accept this Participant Agreement on his behalf.


Limitation of liability and damages.

In no case shall we be liable for damages, losses, claims, damages or any special, punitive, exemplary, direct, indirect, incidental or consequential damages of any kind, whether by contract, extra contractual or strict. liability or otherwise, arising out of or related in any way to the Tour, even if the possibility of such damages is reported.


Travel notices and warnings.

It is your responsibility to be informed about the most recent travel advisories and warnings by consulting the travel website of the State Department of your country.


Major force.

We assume no liability for personal injury, property damage or other losses, accidents, delays, inconveniences or irregularities that may be caused by any matter beyond our exclusive control, including, but not limited to, a delay or cancellation that causes it. Missing all or part of the Tour, acts of God, acts of government, war, terrorist acts, riots, disasters, extreme weather conditions or strikes. We do not have any special knowledge about the financial condition of the Suppliers, unsafe conditions, health risks, climatic risks or extreme weather conditions in the places where you can travel. You understand that rules, facilities, and health care services abroad may be different or even inadequate for the treatment of medical conditions. To obtain information about possible dangers in destinations abroad, we recommend visiting the website of the Office of Consular Affairs of the Department of State that lists the travel tips of each country. To obtain medical information, we recommend contacting the Centers for Diseases.

 

Take risks and release.

If you participate in activities during your trip, certain risks and dangers may arise, including, but not limited to, the risk of accidents in remote locations without access to medical facilities, transportation or means of rapid evacuation and assistance. The dangers of traveling in unsafe or politically unstable areas or in unsafe conditions; the dangers of civil unrest, war, extortion, kidnapping and terrorist activities; dangers and risks inherent to activities in underdeveloped countries; and the dangers of local police activity. You hereby expressly assume all these risks and dangers, and hereby expressly agree to release, dismiss and hold us and our agents, employees, officers and directors, harmless against any liability, actions, causes of actions, claims and claims . and demands of each and every one of the types and nature that you have now or that may arise from here on or in relation to your Trip or participation in any activity in which you participate.

 

General.

You hereby agree to the use of images or videos of you in our marketing materials without compensation. The transmission by fax or scanned of any signed document will be considered delivery of an original. If there is any conflict between this Participant Agreement and the Itinerary, this Participant Agreement will apply. All requests are subject to review and approval. We reserve the right not to do business with anyone in a non-discriminatory manner.


Active elements, medical conditions and special assistance.

Some of our Tours incorporate active elements such as hiking, climbing or canoeing; You are responsible for becoming familiar with the level of activity that will participate in your Tour. You must disclose on your Participant Information Form (or at a later time that you become aware of such condition) any existing physical or mental illness, disability, pregnancy or any other condition that may create a health hazard to you or others. people during the Tour. or for which you may need medical attention or special accommodations during the Tour. We will make every reasonable effort to meet your needs, but you must notify us at the time of booking to determine what assistance we can reasonably provide. We regret we can not serve you if you have special needs for normal daily activities, such as walking and dining. In no case will our suppliers or we elevate or physically assist you to get on or off any vehicle. If we can not meet your special needs, you must be accompanied by a companion who will be responsible for providing the necessary assistance independently.


We reserve the right to refuse the acceptance of any person that we deem inappropriate due to their physical condition. We also reserve the right to withdraw you from the Tour, on your own, if your condition is such that it could create a danger to you or others, or affect the enjoyment of other passengers.
